These Participation Terms apply to guests attending the Checked Out Marbella stay at the Gran Marbella Resort & Beach Club (the “Hotel”).
Your accommodation booking and payment are made directly with the Hotel under its terms. Spacey International Limited (“Checked Out”, “we”, “us”) does not sell accommodation or take guest payments.
We act as a partner to the Hotel to deliver the Checked Out experience and programme, which includes activities, meals, drinks, and events. We do not sell flights, and ATOL/ABTA protections do not apply.
Checked Out is a curated experience exclusively for solo guests. Admission is by acceptance only — we operate a strict selection process, and your booking confirms that you have been accepted.

If you misrepresent yourself or breach the solo guest requirement, you may be denied participation in the programme without refund (refunds fall under the Hotel’s booking terms).
In line with Spanish Hotel and security regulations, guests must present:
These checks are mandatory for Hotel admittance. Failure to comply may result in denied entry without refund.
Your accommodation contract, payment, and any cancellation or refund rights are governed by the Hotel’s booking terms. Checked Out does not collect payment or issue refunds. We receive a commission from the Hotel for delivering the programme.
Travel (including flights or transfers) is not included.
Your booking with the Hotel covers accommodation, scheduled meals, snacks, drinks, and group activities as described in the Checked Out programme. Checked Out curates and hosts this programme in partnership with the Hotel but is not the contracting party for these services.
Extras: Any extras — including minibar items, spa treatments, room service, or food/drinks outside the official programme — are payable directly to the Hotel.
Deposit: On arrival, the Hotel will require a €150 card deposit to cover any extras outside your Checked Out stay, such as room service, spa treatments, or laundry. This will be refunded according to the Hotel’s policy, minus any used charges incurred.
Rooms are available from 3:00 PM on the day of arrival, with check‑out by 12:00 PM on the final day. While the experience runs across three full days, room access follows standard Hotel timings. Luggage can be safely stored with reception before check‑in and after check‑out.
All activities - whether wellness, sport, outdoor, or otherwise - are optional and undertaken entirely at your own risk.
Checked Out and Spacey International Limited do not accept any liability for injuries, health issues, or losses arising from activity participation.
We’ll be capturing content, including photography and video, throughout the stay for use across Checked Out and Spacey International Limited’s platforms, including:
We’ll always aim to be respectful. If you do not wish to appear in any content, you must let us know in advance, and we’ll do our best to exclude you from shots.
All media content is the sole and exclusive property of Spacey International Limited. No compensation will be provided for such use.
Guests are expected to:
Excessive intoxication, illegal substance use, or actions that endanger yourself or others will result in immediate removal from the event.
Guests who breach conduct expectations or disrupt the experience may be removed from the event without refund.
Room types and assignments are determined by the Hotel, in consultation with Checked Out. While preferences can be noted during booking, they are not guaranteed.
The Checked Out programme is curated and delivered by Spacey International Limited. While we are committed to delivering each stay as planned, we may amend or cancel elements of the programme in exceptional circumstances (e.g., operational, logistical, or external challenges).
Your booking contract for accommodation and board remains with the Hotel. Any refunds (if applicable) are governed solely by the Hotel’s booking terms. Checked Out cannot issue or authorise refunds.
We are not responsible for additional costs such as travel or accommodation outside the official programme, and we strongly recommend taking out personal travel insurance.
Spacey International Limited will not be liable for any delays to the programme or failure to perform obligations under these Terms if caused by events outside our reasonable control, including but not limited to: Acts of God, natural disasters, war, terrorism, civil unrest, industrial action, public utility failures, or extreme weather.
Checked Out accepts no liability for programme changes caused by such events. The Hotel operates its own force majeure terms covering accommodation and payment.
Your booking contract is with the Hotel. The Hotel may share limited personal data with us (excluding payment details) only as necessary for us to confirm your participation and deliver the Checked Out programme. We process such data in line with our Privacy Policy.
Checked Out is responsible for delivering the programme with reasonable care and skill. Your accommodation contract, facilities, and related services are the responsibility of the Hotel, and any issues should be addressed directly with them.

For clarity, we do not sell or arrange flight-inclusive or package holidays, and ATOL/ABTA protections do not apply.
You are strongly encouraged to take out your own travel and health insurance.
These terms are governed by Spanish law, and any disputes will be subject to the exclusive jurisdiction of the courts of Spain.
